CPSC Compliance Just Got Stricter: Why Amazon Sellers Need an Amazon Seller Lawyer, Not Just a Test Report

On July 8, 2026, the U.S. Consumer Product Safety Commission's new eFiling requirement took effect. Imported consumer products that require a Children's Product Certificate (CPC) or General Certificate of Conformity (GCC) must now have key certificate data filed electronically through Customs' ACE system before the goods arrive in the United States.


For Amazon sellers, this is more than a customs formality. It marks a shift in how the U.S. regulates product safety, away from spot checks and toward proactive, data-driven enforcement. Sellers whose compliance paperwork is incomplete now face problems at the border, on the platform, and potentially in front of a federal regulator. Understanding when to handle these issues yourself and when to bring in an Amazon seller lawyer can make the difference between a paperwork fix and a full-blown investigation.



What Is the CPSC, and Why Do Amazon Sellers Hear From It?


The Consumer Product Safety Commission is the federal agency responsible for reducing the risk of injury from consumer products. Its jurisdiction covers an enormous range of everyday goods sold on Amazon: toys and children's products, furniture, home goods, small appliances, fitness equipment, and more.


Unlike a trademark or copyright complaint, a CPSC matter has nothing to do with intellectual property. Many sellers' first reaction to a CPSC notice is, “I'm not infringing anything, so why am I being investigated?” The answer is that the CPSC is asking a different question entirely: whether your product meets U.S. safety requirements. Common reasons sellers receive CPSC attention include:


• Consumer injury reports, such as burns, fires, choking hazards, or pinch injuries linked to a product

• Missing or inadequate testing: children's products in particular require third-party testing and documentation

• Platform escalation: Amazon increasingly removes listings and demands compliance documents when regulators flag a product category


What Changes Under the New eFiling Rule?


Under the new regime, certificate data must be filed electronically before goods arrive in the U.S. For sellers, that has several practical consequences. Products that previously entered the country and only faced scrutiny later can now be flagged before clearance. Shipments may be detained at the port. Amazon may require supplementary compliance documentation before reinstating a listing. And gaps in your paperwork are now visible to regulators as data, not just something an inspector might or might not catch.


In short, non-compliance that once surfaced occasionally now surfaces systematically.


Can You Keep Selling After a CPSC Notice?


It depends on what the notice says. In some cases, the platform or agency is only requesting test reports, product information, or certificates, and a well-documented response resolves the issue. In others, where the product presents a genuine safety risk, sales may be suspended and a recall may be on the table.


What sellers should not do is ignore the notice or quietly delete the listing. If the CPSC has opened an inquiry, removing the product page does not close the file. Deleting listings can also complicate your position later, because the agency expects sellers to cooperate, preserve records, and respond substantively.


When to Involve an Amazon Seller Lawyer

• You have received a formal CPSC inquiry, investigation notice, or document request

• A recall, corrective action plan, or civil penalty is being discussed
